Design the process first
Define the evidence required, affordability method, reference questions, occupancy limits and decision record before enquiries arrive. Give each applicant the same core information and a reasonable way to explain non-standard income.
A consistent process improves decisions and demonstrates that criteria relate to the tenancy rather than personal assumptions.
Remove unlawful blanket rules
In England from 1 May 2026, landlords cannot refuse to rent simply because a person receives benefits or has children. Superior lease, mortgage and certain insurance terms cannot justify the prohibited discrimination.
Wider Equality Act duties continue to apply. Review advert wording, filters, agent instructions and automated messages for indirect barriers.
Check identity without profiling
Right to Rent applies to adult occupiers in England, including lodgers. Check everyone using the prescribed process rather than selecting people based on name, accent or perceived nationality.
Keep decision notes proportionate, factual and secure. Delete applicant data when it is no longer required under your retention policy.
