The landlord’s Renters’ Rights checklist for 2026

A post-commencement audit for English landlords covering agreements, information, adverts, rent and possession.

Update the tenancy journey

Most assured shorthold tenancies became assured periodic tenancies on 1 May 2026. New covered tenancies are periodic and cannot use a contractual end date in the old way. Review templates, website copy, staff scripts and automated reminders.

Existing written-tenancy households needed the official information sheet by 31 May 2026. Where there was no written agreement, prescribed written information was required. Retain proof of delivery.

Correct adverts and money collection

State a specific rent in every written advert. Do not invite, encourage or accept an offer above that figure. Do not take rent before the agreement is signed; after signing, generally take no more than one month in advance.

Retain permitted-payment caps, protect qualifying deposits and document how each holding deposit is handled. Remove blanket exclusions for children or benefit recipients.

Rebuild management processes

Use Form 4A and the annual timetable for rent increases. Create a consistent written pet-request process. For possession, identify a statutory ground, evidence, notice period and any protected period before serving.

This is an operational audit, not only a template change. Train every person who advertises, conducts viewings, takes payments or communicates with tenants.
